The best IEP lawyer for your child understands federal and Massachusetts special education law, knows how Team meetings and evaluations work, and can push a school district to provide the services your child needs. This page explains what to look for and what to ask.
Sofio Law, PLLC represents South Shore families in special education matters. Before becoming a lawyer, Attorney Jessica R. Sofio taught in special needs inclusion classrooms, working with IEPs and 504 plans every day. She knows the process from both sides of the table.
What to Look For in an IEP Lawyer
Special education is its own world. Look for these strengths:
- Classroom-level understanding. Good IEPs depend on details: goals, service hours, accommodations, and progress reports. Your lawyer should read an IEP the way an educator does.
- Knowledge of the law. The federal IDEA and Massachusetts law, M.G.L. c. 71B, require a free appropriate public education. Section 504 covers students with disabilities who need accommodations.
- Experience with evaluations. You can request an evaluation, and if you disagree with the school’s evaluation you may be able to request an independent educational evaluation.
- Ability to resolve disputes. Many disagreements are settled at the Team meeting or through mediation. Others go to the Bureau of Special Education Appeals.
- A collaborative tone. Your child will stay in that school system. The right lawyer is firm without burning bridges.
Questions to Ask an IEP Lawyer
These questions help you find the right fit for your child:
- Have you worked with IEPs and 504 plans in a school setting?
- Will you attend Team meetings with us?
- Should we request an independent evaluation?
- What are our options if the district says no?
- How do you charge?
How Sofio Law works. Attorney Sofio reviews your child’s records, evaluations, and current IEP or 504 plan, and helps you set clear goals for the next Team meeting. Your first consultation is free.
Frequently Asked Questions
Who is the best IEP lawyer in Massachusetts?
There is no official ranking. Look for a lawyer who understands both special education law and how schools actually run, who will attend Team meetings, and who keeps your child’s needs at the center.
What is the difference between an IEP and a 504 plan?
An IEP provides specialized instruction and related services under special education law. A 504 plan provides accommodations so a student with a disability can fully access school.
Do I need a lawyer for an IEP meeting?
Not always. A lawyer can help when the school denies eligibility or services, when evaluations are disputed, or when a placement is at issue.
What is the BSEA?
The Bureau of Special Education Appeals is the Massachusetts agency that handles mediation and hearings in special education disputes.
Can I reject an IEP in Massachusetts?
Yes. Parents can accept, reject, or partially reject a proposed IEP. Rejected portions can then be addressed through further meetings, mediation, or the BSEA.
